Terms of Service

These terms cover the website, the published framework, and the free diagnostic. Paid engagements are governed by a written statement of work, not by this page.

1. Acceptance of Terms

By accessing or using harborgovcon.com (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Site.

These Terms apply to every visitor. By using the Site, you represent that you are at least 18 years of age and have the legal capacity to enter into them.

In these Terms, "HARBOR," "we," "us," and "our" refer to HARBOR Initiative LLC, a Texas limited liability company, the operator of harborgovcon.com.

2. What the Site Is

The Site publishes writing about federal productization, describes a six-stage framework, offers one free diagnostic (HARBOR Signal), and describes fixed-scope engagements.

  • Educational content. Articles, guides, framework pages and the books, offered for information.
  • The diagnostic. HARBOR Signal is free. It scores a firm against its own answers and shows public federal contract data. It is a reading aid, not an audit, and it is not professional advice.
  • Links to other services.The books are sold by Amazon under Amazon's terms. HARBOR Port is a separate service at port.harborgovcon.com under its own terms. Those two relationships are theirs, not this page's.

The Site has no user accounts, no paid subscription, and takes no payment. Nothing on the Site is an offer capable of acceptance.

We may change, suspend or withdraw any part of the Site at any time. The published framework and the books remain available if the Site does not.

3. Engagements Are Governed by a Statement of Work

Paid work is not sold through the Site. Each engagement is agreed in a written statement of work, signed before work starts, and that document controls scope, deliverable, fees, payment schedule, refunds, cancellation, and liability for that engagement.

Where a statement of work and these Terms disagree about an engagement, the statement of work wins. The prices and timelines printed on the Site are floors and planning ranges, not quotes, and they bind nobody until a statement of work says so.

The Site describes outcomes that an engagement aims at. A target is not a guarantee, and the pages that describe a target say so.

4. What You Agree Not to Do

When using the Site, you agree not to:

  • Use the Site for an unlawful purpose or in violation of any applicable law or regulation.
  • Attempt to gain unauthorized access to any part of the Site or the systems connected to it.
  • Interfere with or disrupt the Site or its networks.
  • Copy, modify, distribute, sell, or lease any part of the Site without our written permission, apart from the rights section 5 gives you.
  • Reverse engineer or attempt to extract the source code of the Site.
  • Use an automated system, including robots, spiders or scrapers, to access the Site in a way that burdens it. Ordinary search indexing is welcome.
  • Transmit any virus, malware or other malicious code.
  • Impersonate any person or entity, or misrepresent your affiliation with one.

5. Intellectual Property

The Site and its original content are owned by HARBOR and protected by copyright, trademark, and other intellectual property laws.

The HARBOR framework. The framework, including its methodology, terminology (Harvest, Architect, Risk-Proof, Build, Operate, Replicate), processes and associated materials, is proprietary. You may read it, cite it, and use it inside your own firm. You may not reproduce, distribute or create derivative works from it for commercial purposes without our written consent.

Content and the diagnostic. The articles, guides, framework pages and the diagnostic are protected by copyright. You may use a diagnostic report for your own internal business purposes, and you may quote a passage with attribution. You may not republish the content wholesale or claim authorship of it.

Trademarks. "HARBOR," "HARBOR GovCon," "HARBOR Signal," and "HARBOR Port" are trademarks or common-law marks of HARBOR Initiative LLC. You may not use these marks without our prior written permission.

6. Disclaimer

THE SITE IS PROVIDED FOR INFORMATION AND PLANNING PURPOSES ONLY.

The content and the diagnostic help government contractors think through productization decisions. They are not a substitute for professional advice.

Not financial advice. Cost ranges, multiples and economic models on the Site are planning figures drawn from the sources named beside them. They are not financial advice, and you should consult a qualified professional before making an investment or business decision.

Not legal or procurement advice. Material about compliance, FedRAMP, contract vehicles, data rights and government contracting regulations is educational. It is not legal advice, and the clause in your own contract decides what applies to you.

No guarantee of outcome. We aim for accuracy and cite our sources, but we do not warrant that the content is complete or current, and federal rules change. Your use of the Site and your reliance on anything in it is at your own risk.

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HARBOR INITIATIVE LLC, ITS OFFICERS, EMPLOYEES, AGENTS AND LICENSORS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE OR GOODWILL, RESULTING FROM:

  • Your access to the Site, or your inability to access it.
  • Conduct or content of a third party on the Site.
  • Content obtained from the Site.
  • Unauthorized access to, or alteration of, your transmissions or content.
  • A business decision you made on the basis of information or a diagnostic result from the Site.

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR ANY OTHER THEORY, AND WHETHER OR NOT WE WERE INFORMED OF THE POSSIBILITY OF THAT DAMAGE.

Nothing in this section limits liability that cannot be limited by law, and nothing in it applies to a paid engagement, which is governed by its statement of work.

8. Access and Withdrawal

The Site is free and has no accounts, so there is nothing for you to close. We may withdraw or reorganize any page at any time. If we withdraw the Site, these Terms end with it, apart from the sections that by their nature survive: ownership, warranty disclaimers, and limitations of liability.

9. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. The federal and state courts located in Fort Bend County, Texas have exclusive jurisdiction over a dispute arising out of or relating to these Terms.

A dispute arising out of or relating to these Terms or the Site is resolved by binding arbitration under the rules of the American Arbitration Association. The arbitration is conducted in English, and the arbitrator's decision is final and binding.

Our failure to enforce a right or provision of these Terms is not a waiver of that right.

10. Changes to These Terms

We may modify these Terms at any time. If a revision is material, we will try to give at least 30 days' notice on this page before it takes effect. What counts as material is our call, and we will say so in the change note.

Continuing to use the Site after a revision takes effect means you accept the revised Terms. If you do not, stop using the Site. Changes take effect when they are posted here.

12. Export Control

The Site is subject to U.S. export control and economic sanctions law. You represent that you are not located in an embargoed jurisdiction and are not on a U.S. government denied-party list, including the Treasury OFAC SDN List, the Commerce Entity List, and the State Department debarred-parties list.

13. Accessibility

HARBOR Initiative LLC works to make the Site accessible. We target conformance with the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA and Section 508 of the Rehabilitation Act of 1973, as amended. If you meet a barrier, write to hello@harborgovcon.com and we will fix it.
